Abstract:It has been seen that, the market regulation processes in the 1980s could not produce a standard form of electricity market functioning model in the world and market functioning has different specifications and aspects in most of the countries. As a result of liberalization activities, the role of the state in energy market as entrepreneur especially in generation and trade of electricity gradually has diminished and its functions with regard to regulation has gained importance. Liberalization activities that could be realized hand in hand with healthy reorganization, competitiveness and regulation have produced important stimulus for efficient and competitive market functioning. It is observed that, in every country, independent rules and organizations have been established. Even in EU member states, although the legal framework has been established by Brussels with specific regulations, due to their differences in their economical development processes and energy resources, different market functioning models have been put in place. Although the EU has a set of criteria and directives to constitute the fundamentals of market functioning, in practice each nation state attaches special importance to its own strategic and economical interests in parallel with establishing unique market implementations. Similarly, many different implementation styles can be observed in different states of the USA. The reasons of such differences can be summarized as; development and market liberalization levels of countries, their peculiar industrialization adventures, different social preferences and strategic perceptions. Additionally, even in the most liberal markets, the role of the state as market observer and auditor is still kept intact or even further developed. Turkey, while trying to respond increasing electricity demand due to rapid economic development and social change at one hand, transforming its market from statist structure into free model in the adaptation process of the EU and by the recommendations of the World Bank and IMF on the other hand has confronted with a rapid change. Particularly, together with Electricity Market Law No.4628, which was issued in 2001 by taking the EU directives in to consideration, the major legal arrangement was realized, EMRA (EPDK-Electricity Market Regulatory Authority) as an independent regulatory entity was established, and the secondary legislation was completed on time. Even though there have been some positive progress such as diminishing share of public budget contribution in energy investments, it has also been observed some problems such as the vulnerability of supply security, rising external dependency in energy resources, formation of excessive prices in spot market, the absence of long-term strategic targets. It is quite obvious that applying major universal standards into the newly emerged free electricity market by caring the experiences of other countries is needed. However, it is also needed to conceive that there is no unique successful model in the world. The existing functioning model of the electricity market should be revised in accordance with the tenets stated above. In this study, restructuring process is analyzed and some recommendations for the upcoming period are made.
