Abstract:
Zoning peace is an implementation that entered into force in 2018 as part of disaster risk preparation for the registration of unlicensed buildings and the buildings contrary to the license and its annexes. The aim of this study is to investigate the relationship between the implementation of zoning peace (2018) and the gecekondu phenomenon and to discuss the contribution of the implementation of zoning peace to the welfare of the individual and society in accordance with the principle of public interest. Within the scope of the study, after clarifying the reasons for the emergence and implementation processes of the zoning peace, both the legal and administrative gains regarding the gecekondu problem and their reflections on the urban space are examined. The city center of Zonguldak, where the gecekondu and planned constructions coexist, but the squatting is intensely observed, is chosen as the case study area. In the study, the zoning peace applications made for the buildings within the boundaries of the Zonguldak Municipality, which is the city center, were evaluated, the spatial distribution of the demand was investigated, and the changes in the squatter rate before and after the zoning peace were determined. 9,853 of the 16,833 buildings in the city center of Zonguldak are the gecekondu. In Zonguldak city center, the number of buildings with building registration certificates is 3,656. The number of building registration certificates for residential buildings is 2894. Building registration certificates were obtained for 2,894 gecekondu and they gained legal status with the zoning peace in the case study area. After the zoning peace, the number of the gecekondu decreased from 9,853 to 6,959, and the rate of them decreased from 59% to 41%. As a result of the study, the findings were processed into maps and spatialized. This change in the number of the gecekondu does not mean that the spatial problems, caused by the haphazard construction, have been eliminated and that the living spaces of those residents in these buildings have been rehabilitated and improved. For this reason, since the change in the number of the gecekondu that occurred with the zoning peace means that some of the existing slums are legalized and only removed from the shantytown qualification within the legal framework, urban, environmental and social problems in the gecekodondu areas that have benefited from the zoning peace continue to exist. The research opens up the discussion issues regarding the direction of urban planning with the implementation of zoning peace and the possible developments in the field of science and profession in the future.
