Abstract:

In the course of history, real estate acquisition by foreigners has always been a subject of close interest by the public. Both the public and the public authority are interested in the acceptance of the right to purchase property, the acceptability of this with respect to foreigners, and what the international limits of this are. Identifying the problems caused by the practices and the content, this study examines the process of real estate acquisition by foreigners within the borders of the Republic of Turkey in legal and spatial aspects. The study also presents an examination of the extent to which the regulations introduced in this field are appropriate for the public good and national and international law. The study starts with the theoretical framework followed by the present legal regulations. Then, drawing on the reports by Land Registry Office and the Presidential State Supervision Agency, the variability of the real estates acquired by foreigners across the country according to the current law is explicated. As a result of the study, the following conclusions are drawn: the legislation regulating the real estate acquisition by foreigners is disorganized and necessary to be unified through a general regulation; it is obligatory that the related regulations be in accord with the public good; the current regulations do not completely meet this point; a considerable amount of real estate has been acquired by foreigners through the new regulations; certain areas must be limited to the foreigners and this limitation must not be against international law.
